These Terms of Service ("Terms") govern your access to and use of the Call Familiar application, website, and related services (together, the "Service"), operated by Call Familiar LLC ("we", "us", or "our"). By creating an account, joining a playtest, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. During the current playtest, participation is limited to adults residing in the United States, and access is by invitation only. You may use the Service only if you can form a binding contract with us and are not barred from doing so under applicable law.
The Service is an early-stage, pre-release product made available for evaluation and feedback. You understand and accept that:
You may need an account to use parts of the Service. During invitation-only periods, accounts are created for approved participants. You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Provide accurate information, keep it up to date, and notify us promptly of any unauthorized use of your account.
By using the Service, you agree that we may collect information about how the Service is used, and that you may choose to submit bug reports and survey responses. We use this information solely to operate, maintain, and improve the product. What we collect, how it is handled, and the choices you have are described in our Privacy Policy, which is incorporated into these Terms by reference. Where collection is optional, you can manage it in the application's settings or simply choose not to submit a form.
When using the Service, you agree not to:
You retain ownership of the content you create, upload, or share through the Service ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and transmit Your Content (including making the technical copies and format or size adaptations needed to store and display it) solely as needed to operate and provide the Service to you and the people you play with. We will not use Your Content for advertising or promotional purposes without your separate permission. You are responsible for Your Content and for having the rights necessary to use it. Content you share in a live session or with other participants may be visible to and retained by those participants.
The Service, including its software, design, branding, logos, and original content, is owned by Call Familiar LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to use the Service except as expressly permitted here. We reserve all rights not expressly granted.
If you send us feedback, suggestions, or ideas about the Service, you grant us the right to use them without restriction or obligation to you. We may use feedback to improve and develop the Service without compensation or attribution.
We may suspend or terminate your access to the Service at any time, with or without notice, including if you violate these Terms, if we end or change the playtest, or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination (for example, intellectual property, disclaimers, and limitations of liability) will survive.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will be preserved. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, Call Familiar LLC and its members, officers, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed one hundred US dollars (USD 100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
You agree to indemnify and hold harmless Call Familiar LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or of any law or third-party right.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes may also be communicated through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
